Kevin Harvick is no longer locked into a NASCAR Cup Series playoff spot, as his race-winning car from Sunday at Texas Motor Speedway was found to have illegal alterations to the rear spoiler.

NASCAR slammed the Stewart-Haas Racing team with penalties, including not allowing Harvick to use the win for the automatic berth to be among the four drivers who will vie for the championship Nov. 18 at Homestead-Miami Speedway.

Harvick was docked 40 points, crew chief Rodney Childers and car chief Robert Smith were each suspended for the last two races of the season, and Childers was fined $75,000.
"It is not our desire to issue any penalties but will do so when necessary to ensure each race and championship is contested on a level playing field," NASCAR senior vice president of competition Scott Miller said.
The penalty leaves Harvick clinging to the final playoff spot available on points, as he sits three points ahead of Kurt Busch and 17 points ahead of Chase Elliott going into the elimination race Sunday at ISM Raceway in Phoenix.

SHR will not appeal the penalty. Former Cup crew chief Tony Gibson will replace Childers.

"We work tirelessly across every inch of our racecars to create speed and, unfortunately, NASCAR determined we ventured into an area not accommodated by its rule book," SHR vice president of competition Greg Zipadelli said Wednesday in a statement. "We will not appeal the penalty. Instead, we will direct our immediate focus to this weekend's event in Phoenix and control our destiny on the race track."

Joey Logano is the only driver locked into the final four, while Kyle Busch (28 points ahead of his brother Kurt) and Martin Truex Jr. (25 points ahead) have cushions that should allow them to advance if they run reasonably well at Phoenix.

Phoenix is one of Harvick's best tracks. He has nine Cup wins there, including the most recent race in March. He has won seven times in his past 12 starts -- and finished outside the top-5 only twice in those starts -- at the 1-mile flat track.

While the track has remained the same, the race Sunday will be the first with a relocated start-finish line, now positioned in the dogleg portion of the former Turn 2.

NASCAR on Wednesday also penalized Ryan Blaney, who finished second at Texas, and Erik Jones, who finished fourth. They were docked 20 points as well as having their car chiefs suspended for two races and their crew chiefs fined $50,000.

Blaney had a door front crush panel violation as the filler panels didn't remain permanently attached, and Jones had a package tray violation. Both drivers were eliminated in earlier rounds of the playoffs.

Looks like Harvick still records a first place finish @ Texas , so the points in our pool still stand as is.
What I could find about that is only the quote below from an article at nascar.com, which does indicated Harvick still gets the win.
So unless something changes then we are okay as is :)

The penalty takes out the crew cheif and one other crew member for the final 2 races.
With it being the last 2 races, that penalty is extra harsh and prolly one of the harshest penalties nascar can give considering the time of the season and what is at stake :eek:

Yes the win still stands in record books, O'Donnell and Phelps have already said today that next year, they are looking at changing the rule, if you get a level 1 penalty after a race, you lose everything, like you didnt show, any points earned, etc, you weren't there, if that were the urle today 4 car wouldn't be +3 in points ahead of cut line and still have a chance,

I am good with that, even though a 4 fan, gives nascar another black eye that you got to break rules to win,

What they did, was bevel the screw sets under the spoiler so they could adjust the height of spoiler after inspection and OLS, which created more downforce on the 4 car and less air over the nose of the car behind em, creating less downforce, pretty fokkin crafty if you ask me, but nascar is clear dont fok with equipment mandated to spec,

Yeah, no change in the pool results. Everyone, except Ryu and orziz, had Harvick in their picks, and the top 4 picked him as the favorite. Now, if he was outright disqualified, and it was a DieCast race, we might have to reconsider.

these rules got created because of the 48 team

Fok the 48, lol, I was laughing when him and Chad announced no more, Knaus is a great crew chief, knows how to set up a car, problem was Johnson doesnt know now how to drive a car when rules got tightened up on spec, lol, he wanted more, Chad says all we got within tolerances . . . maybe I need re-think my argument, lol, nah, fok the 48,
