View Full Version : Man Accidentally Records Doctors Mocking Him During Colonoscopy, Wins $500K Lawsuit

What a pain in the butt. A Virginia man known as "D.B." went in for a routine colonoscopy at Dr. Tiffany Ingham's practice in 2013, and ended up learning the hard way what doctors talk about during medical procedures. Using his cell phone to record the discharge instructions, the patient forgot to stop recording and ended up accidentally taping every word said in his procedure room.

"After five minutes of talking to you in pre-op," the anesthesiologist told the sedated patient while he was under, "I wanted to punch you in the face and man you up a little bit." A medical assistant was later instructed to lie to the patient and put a false diagnosis in his medical chart.

The assistant noted their patient had a rash, and the brash anesthesiologist warned her not to touch it. "[You might get] some syphilis on your arm or something," the doctor, who also called the patient a "retard," said. "It’s probably tuberculosis in the penis, so you'll be all right."

Ingham, 42, her colleagues, and their practices were sued for defamation and medical malpractice by the patient, who remained anonymous during the court proceedings. Following a three-day trial last week, Dr. Ingham was ordered to pay him $500,000. Her practice, Aisthesis in Bethesda, Md., is ordered to pay $50,000 in punitive damages. Ingham no longer works at the practice, and is said to have moved to Florida.

details:

1. The lawsuit was for $1.7M. The payout was lowered to $500K.
2. In addition to the STD and phallus jokes, she referred to him as the non-PC version of mental handicap and made a couple homophobic remarks as well.
3. Dr. Ingham is an anesthesiologist, not a surgeon. There was a gastroenterologist as well, performing the colonoscopy. Think about exactly why those homophobic remarks are really inappropriate here.
4. Other staff were also present, including a medical assistant whose job is to do what they are told by the doctors. In this case, that job included entering a false diagnoses of 'hemorrhoids' on his permanent medical records.

8. The man didn't record this by lucky accident. He was intending to record the post-op instructions. Important because: anesthesia makes you hazy. He probably had permission to do this from one of the staff, who knew exactly what would happen.
9. Of all the assembled people in the room, the anesthesiologist was the only one behaving this way. As such, the only one sued.

Think about that last for a second. There's a reason for it. This is a woman whose job it is to make people feel no pain, and in many cases put her patients completely out of consciousness. She was in the habit of behaving in a way most doctors can't, because of the opportunities her specialty offered her to be abusive and because she's just that kind of nasty person.

Her liability insurance will cover the cost, and one can only hope she'll pay some real consequences down the line if she keeps it up.
